Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website operated by XForm Scientific LLC ("XForm Scientific," "we," "us," or "our") at xformscientific.com (the "Site"), including any purchases made through the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Site.

XForm Scientific provides online tools that allow you to configure and order custom 3D printed lab equipment. All products are manufactured to order based on the parameters you provide through our product builders.

You are solely responsible for ensuring that the parameters you select (including dimensions, quantities, and configurations) are appropriate for your intended use. We manufacture products based on the specifications you submit and are not responsible for design choices made by you.

All products are produced using 3D printing technology, which is subject to inherent manufacturing tolerances. Dimensions and features specified through our builders are approximate targets, not guarantees of exact measurements. Minor variations in dimensions, surface finish, and hole sizing are normal characteristics of 3D printed parts and do not constitute defects.

The 3D previews and visualizations displayed on the Site are provided as approximate design aids only. While we strive to make them as accurate as possible, they may not perfectly represent the final manufactured product in all details. The previews are not a guarantee of the exact appearance, geometry, or dimensions of the delivered product.

When you place an order through the Site, you are making an offer to purchase custom products at the prices indicated. All prices are listed in U.S. dollars unless otherwise stated.

Payment is processed at the time of order through our third-party payment processor. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

If we cancel an order after payment has been processed, we will issue a full refund for that order.

In the event of a manufacturing defect or shipping error attributable to us, please contact us at support@xformscientific.com and we will work with you to resolve the issue, which may include a replacement or refund at our sole discretion.

We may, at our sole discretion, choose to issue refunds or credits on a case-by-case basis. Any such accommodation does not establish a precedent or obligation for future transactions.

We aim to manufacture and ship orders within the timeframes indicated on the Site. However, production and delivery times are estimates and are not guaranteed. We are not liable for delays caused by manufacturing, shipping carriers, or circumstances beyond our reasonable control.

Risk of loss and title for products pass to you upon delivery to the shipping carrier.

All content on the Site — including but not limited to text, graphics, logos, software, product builder tools, and design interfaces — is the property of XForm Scientific or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Site without our prior written consent, except as necessary to use the Site for its intended purpose.

Certain features of the Site may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts at our discretion, including for violation of these Terms.

You agree not to use the Site to:

• Violate any applicable law, regulation, or third-party rights.
• Interfere with or disrupt the Site or its underlying infrastructure.
• Attempt to gain unauthorized access to any part of the Site, other accounts, or related systems.
• Use automated means (bots, scrapers, etc.) to access the Site without our written permission.
• Submit false, misleading, or fraudulent orders or information.

The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, XForm Scientific disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We make no representations about the suitability of our products for any specific application or use case beyond general laboratory use.

We do not warrant that products will exactly match the dimensions or specifications entered in our product builders. All products are manufactured using 3D printing, which is inherently subject to variability in dimensional accuracy, surface finish, and material properties. No guarantee of exact dimensional conformance is made or implied.

On-screen previews and 3D visualizations are approximate representations provided for design purposes. They do not constitute a guarantee of the final product's exact appearance or geometry.

You agree to indemnify, defend, and hold harmless XForm Scientific and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction of such courts.

We may update these Terms from time to time. When we make changes, we will revise the "Effective date" at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
